Plaintiff Margaret Arnold, in her role as administrator of Harry  Lanier’s estate, filed her complaint against the Secretary on  December 2, 2020, for violations of the Federal Tort Claims Act  (“FTCA”). (ECF No. 1.) The Secretary filed a Motion to Dismiss for  Failure to State a Claim on August 18, 2021, while also moving to  substitute the United States as the proper defendant. (ECF No.  19.)
