Marks dated 08-09-2019 filed by Panikos Symeou, (Document 187) MOTION to Amend/Correct Second Amended Protective Order filed by Application of Hornbeam Corporation, (Document 186) MOTION to Amend/Correct (Document 106) Protective Order filed by Application of Hornbeam Corporation. For the foregoing reasons, it is hereby: ORDERED that Intervenor Panikos Symeou's le tter motion to compel, (Doc. 157), is GRANTED, and Applicant Hornbeam Corporation's motion to amend the Second Amended Protective Order, (Docs. 186, 187), is DENIED; IT IS FURTHER ORDERED that, in accordance with paragraph 15(c) and (d) of the SAPO, Applicant shall destroy the Responsive Materials within fourteen (14) days, and certify such destruction to counsel for Symeou; IT IS FURTHER ORDERED that, consistent with the representation in the Declaration of Bruce S. Marks, (Doc. 191), t he Responsive Materials shall be preserved by counsel for Symeou for potential discovery in the Delaware Action. IT IS FURTHER ORDERED that Intervenor Panikos Symeou's mo tion to compel, (Doc. 180), is DENIED. IT IS FURTHER ORDERED that, considering the parties' joint status update, (Doc. 181), the Court will not postpone ruling on Intervenor Panikos Symeou's letter motion to compel, (Doc. 157), until res olution of the Florida Litigation. Accordingly, the parties must advise the Court within fourteen (14) days of this order of any additional information the Court should consider in deciding whether good cause exists for modifying the SAPO, or whet her Symeou's requested reliefwinding up these proceedings in accordance with SAPO Sections 15(c) and (d)is appropriate.
