  • MEMORANDUM OPINION & ORDER: #102041 as to Abdulai Fofanah re: (Document 25) MOTION in Limine to admit certain evidence, filed by USA. For the reasons stated herein the Government's motion is granted and the Defendant's motion is denied. Final ly, the Court finds that the probative value of this evidence significantly outweighs any potential for unfair prejudice. As described above, the 2006 arrest and surrounding facts are sufficiently similar to the acts charged in the Indictment, are no more sensational than the crimes charged here, and are probative of the Defendant's knowledge and state of mind at the time of the charged crimes. See United States v. Williams, 205 F.3d 23 (2d Cir. 2000), United States v. Aminy, 15 F.3d 258 (2d Cir. 1994). SO ORDERED. (Signed by Judge John F.
