  • ORDER denying (Document 8) Motion to Amend/Correct/Supplement AND TRANSFERRING PETITION TO THE U.S. DISTRICT COURT FOR THE NORTHERN DISTRICT OF NEW YORK -- For the reasons set forth in the ATTACHED WRITTEN SUMMARY ORDER, petitioner's motion is denied, w ithout prejudice for lack of jurisdiction and the Clerk of the Court is directed to TRANSFER this petition for a writ of habeas corpus made pursuant to 28 U.S.C. §2255 (not §2241) to the U.S. District Court for the Northern District of New York for further proceedings pursuant to 28 U.S.C. § 1406(a) and Local Civil Rule 83.3. The determination as to whether pro se petitioner should be granted in forma pauperis status is left up to the Transferee Court. The Clerk of the Court is further directed to mail a copy of this Electronic Order and the Attached Written Summary Order to pro se petitioner. SO ORDERED by Judge Dora Lizette Irizarry on 01/24/12.
