  • MEMORANDUM OPINION AND ORDER signed by JUDGE WILLIAM L. OSTEEN, JR. on 12/6/2019. For the reasons set forth herein, Petitioner's Verified Petition for Return of a Child Under the Convention on the Civil Aspects of International Child Abduction (Doc. (Document 1) ) is GRANTED. At 9:00 a.m. on December 20, 2019, Respondent shall bring the minor child, J.H.R., to the L. Richardson Preyer Courthouse at 324 West Market Street, Greensboro, North Carolina. At that time, t he U.S. Marshals Service is DIRECTED to supervise the exchange of the child and to assist in the execution of this Order as necessary. FURTHER that Respondent's Motion to Dismiss (Doc. (Document 14) ), Respondent's Motion for Summary Judgment (Doc . (Document 13) ), and Respondent's Motion for Reconsideration (Doc. (Document 15) ) are DENIED. FURTHER that due to Respondent voluntarily withdrawing his Counterclaims (Doc. (Document 7) ), Petitioner's Motion to Dismiss pursuant to Rules 12(b)(1) and 12(b)(6) (Do c. (Document 9) ) is DENIED AS MOOT. FURTHER that Petitioner's Motion for Order Definitively Setting the Date, Time, and Manner of the Childs Return (Doc. (Document 17) ) and Petitioner's Motion for Expedited Consideration of Petitioner's Motion for Order (Doc. (Document 19) ) are DENIED AS MOOT. A judgment in accordance with this Memorandum Opinion and Order will be entered contemporaneously herewith. (Daniel, J)
