The (Document 1) Complaint survives preliminary review. COUNT 1 will pr oceed against DR. DAVID, and COUNT 2 is DISMISSED without prejudice against WEXFORD HEALTH SOURCES, INC. for failure to state a claim. Pursuant to Administrative Order No. 244, Defendant should only respond to the issues stated in this Merits Review Order. The Clerk of Court is DIRECTED to TERMINATE Wexford Health Sources, Inc. as a Defendant in CM/ECF. Because this claim arises from the alleged denial of medical care, the Clerk of Court is DIRECTED to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act.
