  • ORDER: Plaintiff's Complaint (Doc. (Document 6) ) survives initial screening as to Defendants Mitchell, Hart, Brookman, Lashbrook, Baldwin and Does 1-4. Defendant Wexford is dismissed without prejudice, and the Clerk of Court is DIRECTED to TERMINATE Wex ford as a party in CM/ECF. Frank Lawrence will remain a named party in his official capacity. The Clerk of Court shall prepare for Defendants Mitchell, Hart, Brookman, Lashbrook, and Baldwin: (1) Form 5 (Notice of a Lawsuit and Request to Waive Servi ce of a Summons), and (2) Form 6 (Waiver of Service of Summons). The Clerk is DIRECTED to mail these forms, a copy of the Complaint (Doc. (Document 6) ), and this Memorandum and Order to Defendants' place of employment as identified by Plaintiff. Plaintif f's unsigned Motion to Appoint Counsel (Doc. (Document 2) ) is STRICKEN and the signed Motion to Appoint Counsel (Doc. (Document 8) ) is GRANTED. Attorney David G. Penn is assigned as counsel for Tyrone Smith. On or before March 2, 2020, assigned counsel shall enter his appearance in this case. Signed by Judge Staci M. Yandle on 2/7/2020. (bps)
