  • OPINION AND ORDER granting in part and denying in part Defendants' (Document 13) Motion to Dismiss. Because the Complaint does not state a claim against Hamilton, the motion is GRANTED with regard to Joe Hand's claims against him. Joe Hand may a mend its Complaint to cure the deficiencies outlined herein within 14 days after entry of this Order. To the extent the motion relates to Defendants Glover and Phoenix, it is DENIED. Within 30 days after entry of this Order, Glover is DIRECTED to respond to the Complaint by answer or motion to dismiss and Phoenix is DIRECTED to file a notice of appearance of counsel and to respond to the Complaint by answer or motion.
