MEMORANDUM. Signed by Judge Richard G. Andrews on 3/9/2023. (nms)
MEMORANDUM ORDER: The motion to exclude Dr. Maness's supplemental damages report (D.I. (Document 295) ) is DENIED. Pursuant to my previous ruling (D.I. (Document 313) ), however, Dr. Maness may not offer testimony at trial relying on the portions of his supplemental report (D.I. (Document 296) -1 Ex. A at 2-5) that relate to his original "apportionment" method. Signed by Judge Richard G. Andrews on 4/6/2022. (nms)
MEMORANDUM ORDER: While I agree with almost all of the Special Master's analysis (D.I. (Document 252) ), and ADOPT it, I think the Special Master's Order denying Irving's motion to compel (D.I. (Document 242) ) needs to be VACATED to the extent it comple tely denied Irving's motion. Plaintiff is ORDERED to produce any of the PRF files referenced as a "source" in the Excel Analysis that contain raw data from testing conducted on the same prior art tissues ("same"meaning from t he same batch, as defined by purchase date and location) as the ones whose Pa and We values are disclosed in Tables 2 and 3 of the Specification. Irving's motion is otherwise DENIED. In view of the pending trial date, Plaintiff is ORDERED to produce such PRF files as soon as possible. Signed by Judge Richard G. Andrews on 3/31/2022. (nms)
MEMORANDUM OPINION. Signed by Judge Richard G. Andrews on 3/30/2022. (nms)
MEMORANDUM ORDER: Plaintiff is ordered to produce the disputed documents (see Memorandum Order for further details). Signed by Judge Richard G. Andrews on 7/29/2021. (lak)
MEMORANDUM OPINION and Special Master Order #8. Signed by Special Master Chad S.C. Stover on 10/27/2020. (nms)
MEMORANDUM ORDER: Regarding competing proposals for extending portions of the schedule. Signed by Judge Richard G. Andrews on 8/19/2020. (nms)
