For the reasons discussed in the attached Ruling and Order, Defendants' motion for summary judgment is GRANTED in part and DENIED in part. Defendants' motion for summary judgment is denied as to Count One and denied in part as to Count Fou r. Defendants' motion for summary judgment is granted as to Counts Two and Three and granted in part as to Count Four. As summary judgment has been granted on all counts naming the Town of Avon, the Clerk of Court is directed to remove it as a defendant in this case.
