ORDER by Magistrate Judge Scott T. Varholak on 24 February 2023. For the foregoing reasons, the Court GRANTS IN PART and DENIES IN PART Defendant's Motion to Dismiss (Document 23) . Specifically, (1) The Motion is GRANTED to the extent it seeks to dismiss Claims Two and Three and those Claims are DISMISSED WITHOUT PREJUDICE; (2) The Motion is DENIED to the extent it seeks to dismiss Claims One and Four and to the extent it seeks to dismiss Plaintiff's request for attorneys' fees; (3) Plaintiff has 21 days from the date of this Order to file a Third Amended Complaint consistent with this Order; and (4) A status conference is set for April 18, at 9:00 a.m.(cmadr, )
