  • ORDER adopting (Document 43) Proposed Findings and Recommended Disposition in its entirety as this Court's findings in all respects. (Document 30) Motion for summary judgment on the issue of exhaustion is granted. Plaintiff's claims against Defendant Kerstei n are dismissed without prejudice for failure to exhaust administrative remedies. Defendant Kerstein is dismissed as a party from this lawsuit. Plaintiff's (Document 2) complaint is dismissed and plaintiff's motions, (Document 44) , (Document 46) , (Document 47) , and (Document 49) are d enied as moot.
