  • MEMORANDUM OPINION AND ORDER - After careful consideration of the record in this case and the magistrate judge's report, the court ADOPTS the report and ACCEPTS the recommendation. Consistent with that recommendation, the court DISMISSES Adam 39;s claims against the ADOC and DENIES his request for injunctive relief, to the extent he seeks the defendants' termination. Additionally, the court DENIES defendant Spencer's motion for summary judgment on Adam's deliberate indiffe rence claim and defendant Stephen's motion for summary judgment on Adam's failure-to-protect claim based on his placement in a crisis cell on April 7, 2020. The court GRANTS the defendants' motion for summary judgment on the remaining claims, as no genuine issues of material fact exist. The court REFERS this matter to the magistrate judge for further proceedings. Signed by Judge L Scott Coogler on 11/8/2022. (MEB2)
