  • ORDER: This case is before the Court on a Recommendation of the Magistrate Judge entered on 9/27/2022. Doc. (Document 11) . There being no timely objections filed to the Recommendation, and after an independent review of the file, the Recommendation is ADOPTED, and it is hereby ORDERED that this case is DISMISSED without prejudice.   • RECOMMENDATION OF THE MAGISTRATE JUDGE: On 9/2/2022, the Court issued an Order directing Plaintiff to file an amended complaint by 9/16/2022. (Doc. No. (Document 10) .) The Court specifically cautioned Plaintiff that failure to comply with that Order would result in a recommendation that this case be dismissed. However, the September 16 deadline has passed, and Plaintiff has neither complied with nor otherwise responded to the Order. Because Plaintiff has failed to file an amended complaint as directed , the undersigned concludes this case should be dismissed without prejudice.
